Judge Levi Benton Issues Decision

Yesterday, Judge Levi Benton, the 215th State District Court, issued his decision after almost 1 1/2 years of court hearings. Judge Benton sided with METRO and issued the ruling that Daphne Scarbrough, the representative for the homeowners, landowners and business owners, did not have standing to sue METRO.

This is positive for the Mobility Coalition because now that we finally have a decision, the appeal can go forward to the next court. Our trial date of September 29, 2008 will be on hold until the appeal court makes it's ruling. Our attorney, Andy Taylor, will be filing the appeal in the next few days.

Our lawsuit has created great delay for METRO and will be the only way to stop the rail on Richmond Avenue. It will be proven in court that Richmond was not on the 2003 ballot and that METRO needs to take it back to the voters for approval.
